Is Cannabis Legal In New Hampshire?
If you’re following the legislation surrounding cannabis in the New England states, you know Vermont recently legalized. The next state on the watch list is New Hampshire.
Lawmakers in New England aren’t letting Attorney General Sessions’ recent announcement deter them from pushing forward to legalize cannabis in their state. The brand new Hampshire House of Representatives voted 207 139 in favor of a bill which would legalize the possession and cultivation of cannabis. This occurred just under a week after Vermont’s House passed an extremely similar bill.
Is Cannabis Legal In New Hampshire? The History Of The New Hampshire Bill
Initially, the House bill intended full recreational legalization – including taxing and regulating the commercial sale of cannabis products. Before it came up for vote, however, the House voted 183 162 for ending the bill.
In order to keep hope alive, the amended bill allows adults (21 and up) to possess as 3/4s of an ounce of cannabis, five grams of hashish and certain cannabis infused products. Additionally, the bill allowed adults 21 and over the legal standing to cultivate up to 3 mature and 3 immature cannabis plants at home. Therefore, this particular edition of the bill is the one the New Hampshire House passed in early January 2018.
Is Cannabis Legal In New Hampshire? What About Taxation And Sales?
The primary reason behind the amended version of the bill is to improve its ability to pass. Opponents of the bill assert that allowing taxed and regulated sales is jumping the gun as the state waits on a legislative study commission to finish examining the way a legalized market could work in the state. By keeping the bill focused on personal home possession cultivation only, the amendment eliminates fines associated with the recent decriminalization law. Additionally, the commission also gains more time to research and present their recommendation before the state allows sales.
Is Cannabis Legal In New Hampshire? What’s Next For The Bill?
Rather than head to the Senate for review however, the Bill landed at the House Ways and Means Committee. If it doesn’t see some substantial changes while in committee, then it will move on to the Senate. The Senate isn’t as friendly toward legalization as the House, and several previous legalization bills have ended there. What’s different this time is the overwhelming support of the New Hampshire residents who favor legalization. This will hopefully influence the Senate to pass the legislation.
